2. Beta Service Disclaimer

This service is currently in beta testing phase. During the beta period, accounts are not charged for domain usage or any other fees. However, please be aware that the beta period may transition to production at any time without prior notice. Once the service moves to production, normal billing and pricing will apply according to our published rates. We will make reasonable efforts to notify users before transitioning from beta to production status.

3. Modifications to Terms

We reserve the right to modify or update these Terms and Conditions at any time, at our sole discretion. Changes become effective immediately upon posting. Continued use of the service constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically.

4. Use of Service

You agree to use the service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5. Intellectual Property

All content, trademarks, and data on this website, including but not limited to software, databases, text, graphics, icons, and hyperlinks, are the property of Excello Digital or its licensors and are protected by applicable intellectual property laws.

6. Disclaimer of Warranties

We strive to provide a high quality and reliable service to all our users. However, the service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Excello Digital and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of, or inability to use, the service, even if advised of the possibility of such damages.

8. Termination

We reserve the right to suspend or terminate your access to the service at any time, without notice, for conduct that we believe violates these Terms and Conditions or is otherwise harmful to other users or us.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Excello Digital operates, without regard to its conflict of law principles.

10. Refunds, Cancellations, and Termination of Paid Services

Cancellation Right: If you purchase a paid subscription, you have the right to cancel your subscription within fourteen (14) days from the date of your initial subscription (the "Cancellation Period"). To exercise your right to cancel within this period, you must notify us before the period expires. You may cancel your subscription directly through your account settings or by contacting hello@excello.digital.

Refunds: If you cancel your subscription within the Cancellation Period, we will refund all payments made by you without undue delay and in any event not later than fourteen (14) days from the day on which we are informed about your decision to cancel. Refunds will be made using the same payment method you used for the initial transaction, unless you expressly agree otherwise. You will not incur any fees as a result of such reimbursement.

Ongoing Cancellation: You may cancel your paid subscription at any time via your account or by contacting us. Payments are non-refundable except where required by law or otherwise stated. If you cancel, your subscription will remain active until the end of the current billing period. All outstanding fees must be paid prior to termination.

Termination or Suspension: We reserve the right to suspend or terminate your access to the service at any time, without notice, for conduct that violates these Terms and Conditions, non-payment, legal compliance, or if your continued use could cause risk or harm to other users or us. You may delete your account at any time via your account settings or by contacting us. Termination does not affect any rights or obligations (including payment) accrued up to the date of termination. Provisions intended to survive termination (such as confidentiality, payment, limitations of liability, and disclaimers) will remain in effect.

Price Changes: If we change our subscription prices, we will give you at least 30 days’ notice before the new price takes effect on your next renewal, so you can cancel if you do not agree to the price increase.

11. Domain Billing and Activation

Our service operates on a per-domain pricing model. Billing for a domain only begins once it receives its first DMARC report. You can add domains to your account and set up DNS records during your trial period without incurring any charges.

When a domain receives its first DMARC report, it becomes "activated" and billing for that domain starts from the beginning of the current billing cycle. You will only be charged for domains that are actively receiving DMARC reports, ensuring you only pay for the protection you're actually using.

Free accounts are exempt from all domain charges, regardless of the number of domains or reports received.
